Welcome to The Bronze Project.

These Terms of Service set out the terms that apply when you visit our website, place an order, request a bespoke design or otherwise use our website and services.

In these Terms, “The Bronze Project”, “we”, “us” and “our” refer to The Bronze Project, based in Jersey, Channel Islands. “You” and “your” refer to the person using our website or purchasing our products.

Our website and online store are hosted by Shopify, which provides the technology that allows us to offer our products and services online.

By using our website or placing an order with us, you agree to these Terms of Service, together with our [Privacy Policy] and [Refund Policy].

If you do not agree to these Terms, please do not use our website or services.

1. About The Bronze Project

The Bronze Project creates bespoke bronze plaques designed to commemorate loved ones, celebrate milestones and mark meaningful places.

Our plaques may be personalised with names, dates, messages, symbols and other design elements requested by you.

Because our plaques are individually made, each piece may have small variations in colour, texture, finish and appearance. These variations are a natural characteristic of bronze and the traditional casting process and are not necessarily defects.

2. Using our website

You may use our website for lawful purposes only.

You agree that information you provide to us, including your name, contact details, billing information, delivery information and any information supplied for a bespoke plaque, is accurate and complete.

You must not use our website:

  • For any unlawful or fraudulent purpose.
  • To interfere with or disrupt the operation of our website.
  • To attempt to gain unauthorised access to our systems.
  • To introduce viruses, malware or other harmful material.
  • To copy, reproduce or exploit our website or its content without our permission.
  • To impersonate another person or provide deliberately misleading information.
  • To use automated systems or scraping tools to access, copy or collect content from our website without our written permission.

We reserve the right to suspend or restrict access to our website where we reasonably believe these Terms have been breached.

3. Our products

We take care to ensure that product descriptions, photographs and other information on our website are accurate.

However, photographs and digital representations cannot always show the exact colour, texture, finish or scale of a physical bronze plaque. Screen settings and lighting may also affect how colours appear.

Bronze is a natural material and each piece is individually crafted. Variations in colour, patina, texture, surface markings and finish may occur and form part of the character of the finished piece.

We may update product descriptions, designs, availability and specifications from time to time.

4. Bespoke and personalised plaques

Many of our plaques are made specifically to your requirements.

Before production begins, we may provide artwork, a design proof or other representation of the proposed plaque for your approval.

Please check all wording, names, dates, spelling, punctuation and other details carefully before approving your design.

Once a bespoke design has been approved and production has started, changes or cancellations may not be possible.

Where a plaque is personalised or made to your specifications, the usual distance-selling cancellation rights may not apply. Jersey Government guidance specifically identifies goods that have been personalised or made to a customer's specifications as an exemption from the usual right to cancel.

This does not affect your statutory rights where a product is faulty, does not match its description or otherwise fails to meet the standards required by applicable law.

5. Customer-supplied wording and designs

You are responsible for ensuring that any wording, names, dates, images, symbols or other content you provide to us is accurate and that you have the necessary rights or permissions to use it.

By submitting content to us for use on a plaque, you confirm that:

  • The information you provide is accurate.
  • You have the right to provide and use the content.
  • The content does not infringe another person's copyright, trademark, privacy or other rights.
  • The content is not unlawful, defamatory, threatening or otherwise inappropriate.

We reserve the right to decline a design or inscription where we reasonably believe it may breach the law or another person's rights.

6. Design approval

Where a bespoke plaque requires artwork approval, production will begin only once the design has been approved by you.

Once you have approved the artwork, you are responsible for checking the final details.

The Bronze Project is not responsible for errors in wording, spelling, dates or other information that was approved by you, except where the finished product does not correspond with the approved artwork.

We may make minor adjustments to layout, spacing or positioning where reasonably necessary to produce a balanced and legible finished plaque. We will discuss significant changes with you where appropriate.

7. Orders

When you place an order through our website, you are making an offer to purchase the products selected.

Your order will be subject to our acceptance.

We will send an order confirmation to the email address you provide. This confirms that we have received your order but does not necessarily mean that production has begun.

For bespoke products, we may contact you separately regarding artwork, wording or design approval.

We reserve the right to decline or cancel an order where, for example:

  • A product is unavailable.
  • We cannot fulfil the requested design.
  • Information provided is inaccurate or incomplete.
  • We suspect fraudulent activity.
  • The requested content is unlawful or infringes another person's rights.
  • There has been an obvious pricing or product-description error.

If we cancel an order after payment has been taken, we will provide an appropriate refund.

8. Prices

All prices displayed on our website are in pounds sterling (£) unless otherwise stated.

Prices and promotions may change from time to time. The price applicable to your order will be the price displayed when you place the order, subject to any obvious error.

Where applicable, prices will include GST and other mandatory charges in accordance with Jersey requirements. Jersey Government guidance states that goods advertised or marketed in Jersey must display prices inclusive of applicable GST and mandatory charges.

Delivery charges will be displayed separately where applicable.

For deliveries outside Jersey, additional customs duties, taxes or import charges may apply depending on the destination. Unless expressly stated otherwise, these charges are the responsibility of the recipient.

9. Payment

Payment must be made using one of the payment methods available at checkout.

By submitting payment details, you confirm that you are authorised to use the payment method provided.

Payments are processed through third-party payment providers and we do not normally have access to your full payment card details.

If payment cannot be authorised or is subsequently reversed, we may suspend or cancel the order.

10. Production and delivery

Our plaques are made to order and production times may vary depending on the product, design and level of personalisation.

Any production or delivery times provided on our website or during the ordering process are estimates unless we have expressly agreed a specific delivery date with you.

We will make reasonable efforts to meet the estimated timeframe.

However, delays may occasionally occur due to circumstances outside our reasonable control, including delays with suppliers, delivery providers, customs, adverse weather, technical problems or other unforeseen events.

For Jersey deliveries, we will provide the available delivery or collection options at the time of purchase.

We may also offer delivery to the UK, Guernsey and other locations. Available destinations, delivery costs and estimated delivery times will be shown at checkout or confirmed with you.

11. Delivery outside Jersey

Where we deliver outside Jersey, your order may be subject to customs procedures, import duties, taxes or other charges in the destination jurisdiction.

These charges are not controlled by The Bronze Project and, unless expressly stated otherwise, are the responsibility of the customer.

You are responsible for providing an accurate delivery address and any information reasonably required to facilitate delivery or customs clearance.

Delays caused by customs authorities or local delivery providers may be outside our control.

12. Risk and responsibility for delivery

We will take reasonable care when preparing and packaging your plaque for delivery.

If an item arrives damaged, please contact us as soon as reasonably possible and provide photographs of the packaging and product so that we can investigate the issue with you and the delivery provider.

Nothing in these Terms limits or excludes any statutory rights or remedies that apply to you.

13. Returns, cancellations and refunds

Our returns and refunds are explained in our [Refund Policy].

Because many of our plaques are personalised or made to your specifications, they may be exempt from the usual distance-selling right to cancel. Jersey Government guidance specifically lists personalised or made-to-specification goods among the exemptions.

However, this does not affect your statutory rights.

If your plaque is faulty, damaged, incorrectly made, does not match its description or otherwise does not meet the standards required by law, please contact us so that we can investigate and provide an appropriate remedy.

Jersey consumer law provides statutory rights in relation to the supply of goods and services, including requirements relating to the quality and conformity of goods.

14. Product care

Bronze is a durable material designed to age and develop character over time.

The appearance of a bronze plaque may naturally change depending on its environment, exposure to weather and method of installation.

Where we provide product-care or installation guidance, you should follow those instructions carefully.

Unless expressly agreed otherwise, The Bronze Project is not responsible for damage caused by incorrect installation, misuse, accidental damage, unauthorised alterations or failure to follow care instructions.

This does not affect your statutory rights where applicable.

15. Intellectual property

All content on our website, including our name, logo, branding, text, photographs, graphics, illustrations, product designs and other materials, belongs to The Bronze Project or our relevant licensors unless stated otherwise.

You may view and use our website for your personal, non-commercial purposes.

You must not reproduce, copy, modify, distribute, publish, sell or commercially exploit our content without our prior written permission.

Nothing in these Terms gives you ownership of any intellectual property belonging to The Bronze Project.

16. Customer designs and intellectual property

Where you provide your own wording, artwork, photographs, symbols or other content for a bespoke plaque, you retain ownership of any intellectual property you already own.

You give us permission to use that content only as reasonably necessary to design, produce and supply your order.

You confirm that you have the necessary rights and permissions to provide the content to us.

Where we create an original design, artwork or layout for you, ownership of that design remains with The Bronze Project unless we have agreed otherwise in writing.

17. Reviews and feedback

If you choose to submit a review, testimonial, photograph, suggestion or other feedback to us, you confirm that you have the right to provide it.

By submitting feedback, you allow The Bronze Project to use, reproduce and display that feedback for purposes including improving and promoting our products and services.

We will not knowingly use your personal information in a way that conflicts with our Privacy Policy.

If you provide a photograph containing another person, you should make sure you have permission to share it with us for this purpose.

We reserve the right to remove or decline to publish feedback that is unlawful, offensive, misleading or otherwise inappropriate.

18. Third-party services and links

Our website may contain links to third-party websites or use third-party services, including Shopify, payment providers, analytics providers and delivery services.

We are not responsible for the content, availability, security or privacy practices of third-party websites or services.

Your use of third-party services may be subject to their own terms and privacy policies.

19. Shopify

Our website and online store are powered by Shopify.

Shopify provides the technology and infrastructure that allows us to operate our online store, but your purchase contract is with The Bronze Project.

Shopify is not responsible for the products you purchase from The Bronze Project or for fulfilling your order.

Information submitted through our website may be processed by Shopify and other service providers in accordance with our Privacy Policy and their applicable privacy policies.

20. Website availability

We aim to keep our website available and operating properly, but we cannot guarantee that it will always be available, uninterrupted or error-free.

We may temporarily suspend access to the website for maintenance, updates, security reasons or other operational requirements.

21. Errors and inaccuracies

We make reasonable efforts to ensure that information on our website is accurate.

However, there may occasionally be typographical errors, pricing errors, inaccuracies or omissions relating to products, availability, descriptions, delivery charges or other information.

Where an obvious error occurs, we reserve the right to correct it and, where appropriate, cancel an affected order and provide a refund.

Nothing in this section allows us to avoid our obligations under applicable consumer-protection law.

22. Prohibited use

You must not use our website in a way that:

  • Breaks any applicable law or regulation.
  • Infringes our intellectual property rights or those of another person.
  • Attempts to gain unauthorised access to our systems.
  • Introduces malicious software.
  • Interferes with the website or its security.
  • Collects personal data about other users without permission.
  • Uses automated systems to scrape or copy our website without permission.
  • Attempts to impersonate another person or business.
  • Is fraudulent, abusive, threatening or otherwise unlawful.

We may take reasonable action where we believe these Terms have been breached.

23. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful or would otherwise conflict with your statutory rights.

Subject to that, The Bronze Project will not be responsible for losses that could not reasonably have been anticipated at the time the contract was formed or for losses caused by circumstances outside our reasonable control.

We will not be liable for:

  • Loss caused by your incorrect or incomplete information.
  • Damage caused by misuse, incorrect installation or failure to follow care instructions.
  • Changes to the appearance of bronze that occur naturally through ageing or exposure to the environment.
  • Delays caused by circumstances outside our reasonable control.

Nothing in these Terms affects your legal rights as a consumer.

24. Events outside our control

We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances outside our reasonable control.

These may include severe weather, natural disasters, fire, flood, industrial disputes, transport disruption, supplier failure, customs delays, government action, technical failures, power outages or other unforeseen circumstances.

Where such an event occurs, we will take reasonable steps to minimise its impact and keep you informed where appropriate.

25. Complaints and resolving problems

We want to resolve any problems quickly and fairly.

Jersey's Trading Standards Service also provides consumer guidance and advice regarding consumer rights.

26. Governing law

These Terms are governed by the laws of Jersey, Channel Islands.

Where you are a consumer, nothing in these Terms is intended to remove or restrict any mandatory rights or protections that apply to you under the laws of the jurisdiction in which you live.

Where a dispute cannot be resolved informally, the courts of Jersey will have jurisdiction, subject to any mandatory rights you may have under applicable consumer-protection law.

27. Changes to these Terms

We may update these Terms from time to time to reflect changes to our business, products, website, services or legal requirements.

The latest version will always be available on this page.

Where appropriate, we will notify you of material changes.

Your continued use of the website after updated Terms have been published will constitute acceptance of the updated Terms, where legally permitted.

28. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where possible.

The remaining provisions will continue to apply.

29. No waiver

If we do not immediately enforce a right or provision under these Terms, this does not mean that we have waived that right.
